Under the new CARES Act, in light of the coronavirus outbreak, the Department of Education was required to identify its federal programs which Congress should authorize waivers to alter program requirements.

The big focus was on special education under IDEA and the potential to allow school districts flexibility in serving students with disabilities.  Secretary of Education Betsy DeVos released her waiver recommendations report to Congress.  While there is one disappointing waiver recommendation regarding toddlers with disabilities moving into public school systems from ECI, there are no further special education waiver recommendations as feared by advocates.

The next step is for Congress to consider the report.  It is possible that Congress could authorize waivers not called for by the report.
