INFORMATION ALERT: NOTICE of SETTLEMENT HEARING in NATIONAL FEDERATION of the BLIND, et al v. CARDIOTRONICS


Brown, Goldstein & Levy, LLP, with co-counsel Fox & Robertson, P.C. and Sugarman, Rogers, Barshak & Cohen, P.C., represent the National Federation of the Blind and a class of blind people who, along with the Commonwealth of Massachusetts, reached a settlement in 2007 with Cardtronics, Inc. concerning the accessibility of that company's ATMs. Due to Cardtronics' inability to meet a number of important requirements of the Court's final order of December 4, 2007, the Court has approved the attached Notice of Proposed Remediation Plan and scheduled a Fairness Hearing for September 15, 2010 at 2:30 p.m.

NOTICE OF CLASS ACTION SETTLEMENT


This notice is directed to all persons who are considered disabled under the Americans with Disabilities Act who use wheelchairs, walkers, canes, crutches, or scooters for mobility. If you visited a Snuffer's restaurant you may be affected. If you would have visited a Snuffer's restaurant but for an architectural barrier at the property of which you were aware, you may be affected.

WHAT THIS LAWSUIT IS ABOUT

Patricia Sapp and Jason Swanson, both individuals in wheelchairs, filed a class action lawsuit in the Northern District of Texas, Federal Court, CIVIL ACTION NO. 3:07-CV-0273-M, against Snuffer's restaurants and landlords alleging violations of the Americans with Disabilities Act and State Law for owning and/or operating facilities that are not readily accessible to and usable by individuals with mobility disabilities because of architectural barriers. That case has now been settled.


As a result of that settlement:

If you are a person with a mobility impairment disability as defined by the ADA, your rights may have been affected and you may be entitled to collect $100. To collect your $100.00, obtain a copy of the complete declaration form available at the hostess stand. Just fill it out and return it to the address included in the declaration. Martin Vega and Leslie Greer, persons who use wheelchairs, filed a class action lawsuit against the Café Brazil restaurants and landlords alleging violations of Americans with Disabilities Act and State Law for failure to remove architectural barriers at these restaurants in the United States District Court for the Northern District of Texas.

This case has been certified as a class action. If you are a person with mobility impairment disability and use a wheelchair or scooter and/or a walker, crutches, or a cane to walk you may be entitled to monetary damages in the amount of $100.
